The Federal Acquisition Regulatory (FAR) Council recently issued new guidance implementing EO 14398, “Addressing DEI Discrimination by Federal Contractors” (see Arbor’s previous Client Alert for more information.) The Executive Order titled “Addressing DEI Discrimination by Federal Contractors” establishes new compliance obligations affecting federal contractors and subcontractors. Beginning April 25, 2026, all new federal contracts and contract modifications must include a clause prohibiting certain DEI-related activities.
